"Lincolnband.net", Lincoln District Scout Band and The Scout Association (UK) are committed to protecting your privacy. This Privacy Statement sets out our current data processing practices.

In our Privacy Statement, the term 'personal information' means your contact email address, your home address, your telephone number and any other information collected through this website, that we believe to be of a sensitive or personal nature. Any special requirements/concerns regarding information that you may provide to us, should be made clear when you contact us.

1. Information that you tell us:

We do not give your personal information to third parties (salespeople, advertisers, other websites, etc).  No contact details or any other personally identifiable information, received through this website, will be released in any public context.  The only circumstances in which we provide any of your personal data to a third party are those contained in this Privacy Statement.  All persons under the age of 14 must have permission from their parent or legal guardian before contacting us.

Lincolnband.net does not check or record the specific usage of our website by identifiable individuals.  We do not require you to register, or use passwords or special log-in details to enable you to access any portion of this website.

2. Sharing of Data - Present and Past Band Members:

Your personal information may be used to contact you regarding Band business.  Most people under the age of 14 who wish to make regular contact with us are present band members.  Such contact will be undertaken by appropriate persons who hold current UK Criminal Records Bureau clearance, declaring them fit to work with people under 18 years old, under UK law.

While we can send newsletters to, and enter into email exchange with, band members under the age of 14, we do require that a parent or guardian provide a signed permission form before we do this. Lincolnband.net would prefer this contact to take place through the parent's email address rather than the child's, this enables the parent to see all the information that we send out..

We may legitimately share data supplied by you (or collected about you) with other parts of The Scout Association (UK).  This includes information for The Scout Association annual national census, to support our affiliation, and for equality monitoring purposes/inclusion (e.g. numerical data regarding numbers of males/females, ethnic origin, age, disability status).  As all Band members are members of the Scout Association (UK) or Girl Guiding UK this is considered reasonable.

We may provide your contact details to other Band members or third parties if you have given us permission to do so.

We may wish to use photographs of the band for promotional purposes, for example, on this website.  Band members over 18 and parents of band members under 18 are asked to sign a release form giving permission for such photographs.

We will not sell, share, or rent your information to others in ways different from that disclosed in this Privacy Policy.

3. Sharing of Data - People who are Not Band Members:

Most people contacting us, who are not band members, will be over the age of 14.  We do not accept bookings or booking enquiries from people under 18 years old.  Your personal information will be used only to contact you in respect of enquiries you make relating to the Band.  This may be a booking enquiry; questions about joining the Band; questions about future performances or legitimate discussion about other various aspects of Scouting.  As part of it’s normal operation, Lincolnband.net may send out information emails to certain event organisers prior to an event.  This is to ensure Band availability for the event and to confirm booking details.

We will not sell, share, or rent your information to others in ways different from that disclosed in this Privacy Policy.

4. Legal Jurisdiction:

All personal information and details held on and processed by computers situated in the United Kingdom.

5. Disclosure of data by order of a Court and Security:

We reserve the right to communicate any personal information, that you tell us, to third parties who are empowered by regulation, statute or order of a court.

Lincolnband.net takes every precaution to protect your information.  The servers on which this site resides is administered by a commercial hosting company.  Access to the servers is restricted to trusted personnel and contained in a secure data centre.

The Data Protection Act of 1998

In December 2003, a copy of this Privacy Policy was lodged with the UK Government's Information Commissioner's Office.  On 6 February 2004 the Compliance Officer of that Office replied:

"Based on the information you have provided to us it would appear that the policy is compliant with current legislation."

US Federal Law

The Children’s Online Privacy Protection Act of 1998 (COPPA)

It is our interpretation that Lincolnband.net is NOT REQUIRED BY LAW to comply with COPPA.  Our assessment is based on the following reasons;

  1. the site is the sole property of Lincoln District Scout Band, who are a non-profit making organisation, and a sub-division of Lincoln District Scout Council, which is a UK Registered Charity;
  2. the site is not directed to children in the USA.

However, we believe it is good practice to endeavour to meet the requirements of COPPA on a voluntary basis.

COPPA requires that certain websites obtain verifiable parental consent before collecting personal information from a child under the age of 13.

The location of the "host" computer and server are irrelevant.  COPPA may apply if the site is accessed by children in USA.

The regulations apply to websites and with actual knowledge that they collect personal information from a child. Personal information includes; full name, home address, email address, telephone number, and any other information that the US Federal Trade Commission (FTC) determines "permits the physical or online contacting of a specific individual."

Websites or Operators for whom COPPA is mandatory:

  1. MUST - state what information is collected from children, how it is used and their disclosure practices;
  2. MUST - obtain verifiable parental consent to collect, use or disclose information from children, before it is collected;
  3. MUST - if asked, provide parents/legal guardians with a description of the types of information collected from their child, or the actual information obtained from their child, and give the option to refuse to permit the further use, maintenance or future collection.  (Please note that under English law we are entitled to charge you a fee for providing this service.)  If a parent withdraws consent at any time, the operator must remove that child's personal information from the system;
  4. MUST NOT - request any more information than is reasonable, as a condition of the child participating in any online activity provided on the website;
  5. MUST - take reasonable care to "protect the confidentiality, security, and integrity of personal information collected from children."

On 29 May 2004 Lincolnband.net contacted the US Federal Trade Commission asking them to evaluate our Privacy Policy:

  1. to check whether Lincolnband.net have a legal obligation to comply with COPPA
  2. to assess whether our Privacy Policy complies
  3. to request proposals for amendments to our Privacy Policy to aid compliance
